Rep. James Comer, R-Ky., House Oversight Committee chairman, on Thursday subpoenaed a top aide to former First Lady Jill Biden after he skipped his scheduled appearance before the committee.

Anthony Bernal, who served as a senior adviser, bailed on his scheduled hearing in the House’s investigation of former President Joe Biden’s mental fitness.

Bernal had confirmed his appearance for a voluntary transcribed interview on Thursday, but after the White House Counsel’s office informed him it was waiving executive privilege for the oversight committee’s investigation, his lawyer told the committee that Bernal was no longer willing to appear.

Comer expressed outrage via X and promised to compel a testimony from Bernal.

“The White House waived executive privilege — and Jill Biden’s ‘work husband’ Anthony Bernal ran for cover,” Comer wrote. “Anthony bailed on his scheduled appearance before @GOPoversight today. We won’t tolerate this obstruction & effort to hide the truth. I’m signing a subpoena.”

The oversight committee later shared an image of the subpoena via X. Bernal is scheduled to appear for a deposition on July 16 under the subpoena.

“Anthony Bernal REFUSED to cooperate in our investigation into Biden’s mental decline cover-up this week — we will not allow it, we will compel his testimony,” it read.

The hearing would have been part of Comer’s investigation of who was making crucial decisions for Joe Biden, given the concerns of his mental and physical health. This week, the Oversight Committee heard testimony from former Biden aide Neera Tanden, who said she was authorized to use autopen signatures to sign official documents.

Tanden denied there had ever been a cover-up of Biden’s condition. She also acknowledged having no insight into who approved the use of autopen signatures.

After being questioned in the hearing on Tuesday, Tanden told the Washington Examiner she “was very happy to answer questions. I answered the questions,” and that she was “happy to discuss my public service.” Asked by reporters whether she was covering up Biden’s health, with her responding, “absolutely not.”
