


The Pentagon plans to disqualify transgender service members unless they meet certain requirements, according to a court filing.
“Service members who have a current diagnosis or history of, or exhibit symptoms consistent with, gender dysphoria will be processed for separation from military service,” a memo included in the court filing says.
The memo adds that the military will consider granting waivers on a “case-by-case basis” only if there’s “a compelling government interest in retaining the service member that directly supports warfighting capabilities.”
The court filing, made public Wednesday, is in response to a lawsuit filed in Washinghton on behalf of six transgender service members challenging President Donald Trump’s executive order titled “Prioritizing Military Excellence and Readiness.”
The order said “adoption of a gender identity inconsistent with an individual’s sex conflicts with a soldier’s commitment to an honorable, truthful, and disciplined lifestyle,” and it instructed the secretary of defense to ensure “invented and identification-based pronoun usage” is not the department’s practice.
“It is the policy of the United States Government to establish high standards for troop readiness, lethality, cohesion, honesty, humility, uniformity, and integrity,” the order reads. “This policy is inconsistent with the medical, surgical, and mental health constraints on individuals with gender dysphoria.”
Similar to the executive order, the policy filed Wednesday suggests the lethality and integrity of the military “is inconsistent” with what transgender personnel go through as they transition to the gender they identify with, and issues an edict that gender is “immutable, unchanging during a person’s life.”
If a waiver is issued in either case, the applicant would still face a situation where only their biological sex was recognized for bathroom facilities, sleeping quarters and official recognition, such as being called “Sir” or “Ma’am.”
Gender dysphoria occurs when a person’s biological sex does not match with their gender identity.
The Army announced earlier this month it will “no longer” allow transgender individuals to join the military and it will cease providing gender transition procedures.
“The #USArmy will no longer allow transgender individuals to join the military and will stop performing or facilitating procedures associated with gender transition for service members,” the Army wrote on X.
A 2020 study published by the NIH estimated up to 8,000 transgender people were on active duty.
